Abstract

In the present article the author analyses the main points stated in the negative Opinion of the Court of Justice of the EU regarding the draft Agreement on the accession of the European Union to the European Convention on Human rights. The article presents the comments to the Opinion already made by the researchers and briefly describes possible further developments. The author submits that the position taken by the Court of Justice could be explained by its strategy of gradual judicial federalization of the Union.
