Protocol 15 to the Convention for the Protection of Human Rights and Fundamental Freedoms

A new development stage of the European Court of Human Rights is adoption of the Protocol 15 to the European Convention on Human Rights and Fundamental Freedoms. The Protocol 15 provides for an introduction of amendments in the text of the preamble to the Convention and in some of its articles. The analysis of the forthcoming changes introduced by the Protocol 15 into the text of the Convention in the context of the historical aspects of the development of the European Court is given. Special consideration is given to the introduction into the text of the preamble to the Convention the principle of subsidiarity and the doctrine “margin of appreciation” connected with it.
